Representative Cases

Associated Oregon Industries, U.S Chamber of Commerce v. Avakian (U.S. District Court, Oregon). On behalf of state labor commissioner, obtained dismissal of challenge to law providing rights to workers who decline to attend employer presentations on protected issues

Biomet, Inc. v. Northwest Medical Products, Inc. (U.S. District Court, Oregon). Obtained dissolution of restraining order and summary judgment against non-compete claims by national company

Conwood Corp., et al. v. Kroger (Marion County Circuit Court). Defeated tobacco manufacturers’ free speech challenge to smokeless tobacco marketing restrictions

Estby v. WSCO Petroleum Corp. (Multnomah County Circuit Court). Obtained summary judgment dismissing $1 million claim against client

Forest v. Wheeler (Marion and Multnomah County Circuit Courts). Obtained dismissal of billion dollar claims by pension beneficiaries against several high-level state officials, alleging breach of fiduciary duty and securities violations

Hoyt Street Properties v. BNSF (U.S. District Court, Oregon). Trial team obtained $1 million cleanup jury verdict against BNSF

Lane v. Brown (U.S. Dist. Court, Oregon). Defended State in first-of-its kind disabilities class action, ultimately settled after significant compromises by both sides

Livingston v. Brown (Marion County Circuit Court). Defeated effort to enjoin Measures 66 and 67, which brought hundreds of millions of dollars in critical revenue to State during great recession

Port of Vancouver v. Cadet Mfg. Co. (U.S. Bankruptcy Court, Western District of Washington). Defended claim for more than $50 million in groundwater cleanup costs against Cadet; reached creative settlement including sale of client’s property to the Port with leaseback and an indemnity of Cadet

Portland 76/Auto Truck Plaza, Inc. v. Unocal (U.S. District Court, Oregon). Trial team obtained $7.5 million judgment after jury trial against Unocal on price discrimination claims; later reduced on appeal

Stark v. Washington Public Stadium Authority (U.S. District Court, Western District of Washington). Obtained summary judgment against Fourth Amendment challenge to pat-downs at Seahawks games

Water for Life, et al v. Oregon Water Resources Department (Marion County Circuit Court). Defeated effort to enjoin the Klamath Basin Restoration Agreement, a major state initiative
