Investors represented by Tom Bode prevail in key procedural motion in securities action against Washington-based Unibank
April 21, 2026Larkins Vacura Kayser partner Tom Bode and co-counsel Nico Banks of Banks Law Office defeated Unibank’s Motion to Dismiss in Snohomish County, Washington Superior Court on March 18, 2026. Ruling from the bench, Judge Joseph P. Wilson made favorable comments about the strength of the plaintiffs’ case, which arises from the $700 million Ponzi scheme known as Prestige Funds.
Attorneys Bode and Banks represent plaintiffs in two cases against Unibank, with total investments exceeding $6 million. Both cases allege that Unibank supported the sale of the Prestige Fund securities through a specialized loan program. Unibank had argued that the case should be dismissed because the transaction was no more than a standard commercial loan. The Judge’s ruling allows the case to proceed to trial.
Their victory adds to Larkins Vacura Kayser’s record of success representing investors with claims under Oregon and Washington securities laws.
