We represent lenders and loan servicers in virtually every type of legal dispute they face. We have represented a national bank in a multi-million dollar class action alleging irregularities in residential foreclosures. We have won jury trials (and appeals) for lenders accused of violating the Fair Credit Reporting Act and Fair Debt Collection Practices Act. We regularly defeat claims alleging wrongful foreclosure, lender liability, breach of contract, breach of fiduciary duty, negligence, fraud, misrepresentation, tortious interference, and violations of the Real Estate Settlement Procedures Act, nonjudicial foreclosure laws, and recording statutes. We have successfully pursued claims for credit unions that have been the victims of bank fraud. We guide lenders and loan servicers through bankruptcies filed by borrowers and guarantors, so that our clients can obtain successful recoveries on secured and unsecured claims.
