Larkins Vacura Kayser Helps Petition the Oregon Supreme Court on Behalf of JusticeDecember 8, 2022Larkins Vacura Kayser attorneys Tom Bode and Aly Sneider assisted the Animal Legal Defense Fund in petitioning the Oregon Supreme Court to review a Court of Appeals opinion affirming the dismissal of a lawsuit brought by Justice, a horse who was a victim of animal cruelty. The petition argues that animals who have been subjected to cruelty have legal rights with standing to sue for damages, in keeping with Oregon courts’ established recognition that animals should be considered individual victims for sentencing purposes in cruelty cases.

Larkins Vacura Kayser Prevails on appeal of $3 million arbitration awardOctober 26, 2022Larkins Vacura Kayser attorney Cody Hoesly prevailed before the Oregon Court of Appeals in Floor Solutions, Inc. v. Johnson, 322 Or App 417 (2022). After our client obtained confirmation of a $3 million arbitration award against his former employer for violation of Oregon’s wage statutes, the employer appealed, arguing that the arbitrators had exceeded their powers by manifestly disregarding the law. The appellate court affirmed, holding that “manifest disregard” is not a cognizable basis for challenging an arbitration award under Oregon law.
Larkins Vacura Kayser Prevails on appeal of $9 million damages verdictOctober 10, 2022Larkins Vacura Kayser attorney Cody Hoesly prevailed before the Ninth Circuit Court of Appeals in Moutal v. Exel, Inc., 2022 WL 3031580 (Aug. 1, 2022). Affirming a $9 million jury verdict in favor of our clients, the Ninth Circuit held that the jury properly awarded $4 million in punitive damages where the defendant’s employee drove an 18-wheel semi-truck into our clients as they rode their bicycles. The driver was speeding down a winding road widely known and well-marked as a bicycle route while repeatedly crossing the fog line and jerking back into his lane over the course of two miles. Kelsey Benedick Joins Board of The U.S. District Court of Oregon Historical SocietyApril 20, 2022Larkins Vacura Kayser attorney Kelsey Benedick was recently selected to join the board for The U.S. District Court of Oregon Historical Society, which is dedicated to preserving the history of the U.S. District Court of Oregon and the Oregon legal community. As part of that effort, the Society takes and transcribes the oral histories of judges, attorneys, litigants, and other persons involved in the court’s history. Additionally, the Society hosts an annual picnic and annual awards dinner, and publishes a newsletter with articles based on oral histories, past and current court events, and the Society’s activities, among other things.

Larkins Vacura Kayser Prevails on Whistleblower Retaliation ClaimJanuary 14, 2022Larkins Vacura Kayser attorney Cody Hoesly prevailed before the Ninth Circuit Court of Appeals in Miller v. Watson, 2021 WL 5905722 (Dec. 14, 2021). Reversing the trial court’s grant of summary judgment against our client, the plaintiff, the Court of Appeals held that under Oregon law a statutory whistleblower retaliation claim alleging wrongful discharge does not accrue until the actual discharge occurs, even if the employee receives advance notice of their impending discharge. The court contrasted that rule with the rule governing similar federal claims, under which the claim accrues when the employee receives the notice.

Larkins Vacura Kayser Obtains Favorable Settlement on Behalf of Pro Bono ClientNovember 9, 2021Larkins Vacura Kayser attorney Kelsey Benedick obtained a favorable settlement on behalf of a pro bono client in a Section 1983 civil rights matter. The client, an adult in custody (AIC) at an Oregon prison, represented himself pro se in claims against various Oregon Department of Corrections officials alleging violation of his Eighth Amendment and Fourteenth Amendment rights, among other claims. The U.S. District Court for the District of Oregon appointed Ms. Benedick as pro bono counsel to conduct additional fact discovery and summary judgment briefing, and to potentially take the case to trial. The parties reached a settlement of the dispute during a judicial settlement conference, which resulted in significant monetary compensation to the client, increased access to exercise …
